Please read these Terms and Conditions (“Terms”) carefully before using our service platform. These Terms govern your access to and use of Fixnow’s (“we,” “our,” or “us”) service (“Service”). By using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you should not use the Service.

Service Overview:

Our service platform allows users (“Customers”) to request motorcycle services, repairs, maintenance, and other related services from a network of authorized motorcycle service providers (“Service Providers”).

Eligibility:

By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind such entity to these Terms.

Membership Plan Subscription:

When submitting a service request, Customers must provide accurate and complete information about the motorcycle’s make, model, year, and the specific plan required.

Service Requests:

Customers may place service requests through our website, mobile application or, by call/text.

Service Provider Selection:

We will match the service request with an appropriate Service Provider in the vicinity of the Customer. The selection of the Service Provider is based on factors such as availability, expertise, and customer reviews. We do not guarantee the availability of Service Providers at all times.

Service Pricing:

The pricing for motorcycle services will be determined by the selected Service Provider based on the specific service requested and any additional parts or repairs required. Customers will receive an estimate before confirming the service. The final cost may vary from the initial estimate if additional repairs or parts are necessary, and Customers will be informed of any changes in pricing before proceeding with the service.

Payment and Charges:

Customers will be required to make payment through our secure online payment system. The payment will be processed at the time of confirming the service request. Additional charges for extra parts or services will be billed separately. All payments are non-refundable, except as required by law.

Service Warranty:

The Service Provider is responsible for providing warranty information, if any, for the services rendered. We do not provide any direct warranties on the services.

Parts Warranty:

Fixnow is responsible for the parts warranty, as per the membership plan choosen by the customers.

Customer Responsibilities:

Customers are responsible for providing accurate information about their motorcycles and ensuring that the motorcycle is available for service at the agreed-upon time and location. Customers can cooperate with the Service Provider during the service process.

Service Provider Responsibilities:

Service Providers are responsible for performing the services with reasonable care and skill. They must also maintain appropriate licenses, permits, and insurance as required by law.

Cancellations and Rescheduling:

Customers may cancel or reschedule a service request with reasonable notice. However, if a Service Provider has already begun traveling to the Customer’s location, a cancellation fee may apply.

Limitation of Liability:

We shall not be liable for any damages, losses, or injuries arising from the use of the Service or the services provided by the Service Providers. Customers use the Service at their own risk.

Indemnification:

Customers agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising from their use of the Service or any breach of these Terms.

Modifications:

We reserve the right to modify or discontinue the Service or these Terms at any time without prior notice. Customers are encouraged to review the Terms periodically for any updates.

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the country, without regard to its conflicts of law principles.
